A decree dated 7 September 2026 and published the following day defines the criteria allowing owners of car parks to benefit from an extension to comply with the obligation to install solar panels on car parks larger than 1,500 m², according to Alliance du Commerce. This text sets out the conditions for the extension already granted by the law of 26 November 2025.

The obligation to solarise car parks stems from the law on accelerating renewable energy production of 10 March 2023, known as the APER law. Before the extension introduced by the law of 26 November 2025, the deadline was set at 1 July 2026 for outdoor car parks larger than 10,000 m², and at 1 July 2028 for car parks between 1,500 and 10,000 m².

The decree of 7 September sets out two criteria for benefiting from this extension: a surface area criterion and a technical criterion. A separate regime therefore applies to outdoor car parks with a surface area of less than 10,000 m².

Technical requirements on panels

On the technical front, photovoltaic panels must meet requirements in terms of efficiency, durability, carbon footprint and warranty. The required performance levels are set out in decree no. 2024-1104 of 3 December 2024. Compliance with these criteria must be certified by an accredited body.
